General Application Terms Of Use
These Terms of Use, together with any and all other documents referred to herein, apply to all users of the Helados Mobile Application and the www.heladosonline.com website (“Our Site”). Please read these Terms of Use carefully and ensure that you understand them. Your agreement to comply with and be bound by these Terms of Use is deemed to occur upon the time you download the Helados application, and you will be required to read and accept these Terms of Use when signing up for an account. If you do not agree to comply with and be bound by these Terms of Use, you must stop using Our Site immediately. These Terms of Use do not apply to the sale of Paid Content.
Definitions and Interpretation:
In these Terms of Use, unless the context otherwise requires, the following expressions have the following meanings:
“Account” means an account required for a User to access and /or use certain areas of Our Site
“Content” means any, and all text, images, audio, video, scripts, code, software, databases, and any other form of information capable of being stored on a computer that appears on, or forms part of, Our Site.
“Paid Content” means digital content made available for sale via Our Site

“User” means a user of Our Site
“User Content” means any content submitted to Our Site by Users including, but not limited to, title, name, surname, business name, business description, URL, postal address, telephone number, and email address.
"Mobile Application" is a computer program or software application designed to run on a mobile device such as a phone, tablet, or watch.
“We/Us/Our” means Mamata’s Foods Inc., a direct distributor of ice cream in Clifton, NJ. We service small to mid-size food service retail businesses, with high-quality and cost-effective products. Our Main office is at 500 Getty Ave, Clifton, NJ 07011, USA.
Information About Us:
Helados mobile application and Our Site (www.onlinehelados.com) are owned by Mamita's Foods Inc. Helados is a Business to Business (B2B) distribution application that allows businesses in the food retail industry to purchase ice cream wholesale, directly from manufacturers or major distributors. Helados is own by Mamita's Foods. Mamitas Food's Ice scream division services small to mid-size food retail businesses, with high-quality and cost-effective products by reducing the supply chain.
Access to Our Mobile Application and Our Site:
To purchase products in Our Mobile Application or Site, User requires a membership. The membership cost is $15.00 per month, it will be deducted monthly, using the primary form of payment added to the user profile during registration (e.g., credit card). It is your responsibility to make all arrangements necessary in order to access Our Site.
Access to Our Site is provided “as is” and on an “as available” basis. We may alter, suspend or discontinue Our Site (or any part of it) at any time and without notice. We will not be liable to you in any way if Our Site (or any part of it) is unavailable at any time and for any period.
Required Membership:
The monthly subscription cost is $15.00 per monthly, and it can cancel anytime without penalty. The yearly subscription cost is $180.00, which will be automatically deducted from the User's credit card. We reserve the right to change the membership price. In the event, the membership price is changed users will be notified in advance via email and or SMS (text Message). Membership-related refunds will be issued if applicable based on the date of cancellation. Memberships are paid through the end of the building term. If we are unable to collect the membership fees for any reason, the User account status will change to 'Inactive' and you can reactivate it by updating your payment method.
Return Policy:
All orders are non-refundable. The application allows 15 minutes to cancel an order after it is placed. You can also call our customer service number at 1862-238-8200 to modify an order within 15 minutes of placing it.
Delivery Person / Courier Responsibility:
The delivery representative or courier will deliver the items to the delivery address (inside) but they are not responsible for unpacking and stocking the items. This will be the responsibility of the User.
Accounts:
Certain parts of Helados Mobile Application and Our Site (including the ability to purchase Paid Content from Us) may require an Account in order to access them.
You may not create an Account if you are under 18 years of age.
When creating an Account, the information you provide must be accurate and complete. If any of your information changes at a later date, it is your responsibility to ensure that your Account is kept up to date. We recommend that you choose a strong password for your Account, consisting of a combination of lowercase and uppercase letters, numbers, and symbols. It is your responsibility to keep your password safe. You must not share your Account with anyone else. If you believe your Account is being used without your permission, please contact Us immediately via email at info@heladosonline.com or call us at 1862-238-8200. We are not liable for any unauthorized use of your Account.
You must not use anyone else’s Account without the express permission of the User to whom the Account belongs to.
Any personal information provided in your Account will be collected, used, held, and protected in accordance with your rights and The United States’ applicable data protection regulations. If a User wishes to close his/her Account, they may do so at any time. Closing your Account will result in the removal of your information. Closing your Account will also remove access to the Products section of Our Site. If a User closes his/her Account, any title, name, surname, business name, business description, URL, postal address, telephone number, or email address you have created on Our Site will be deleted but we may still use your contact information (such as email Address, Company Name, Contact Name) to contact the User for product offers and to inform the User of available discounts.
Intellectual Property Rights:
Except for User Content, all content included on Mobile Application and Our Site, the copyright and other intellectual property rights subsisting in that content, unless specifically labeled otherwise, belongs to or has been licensed by Us. All content (including User Content) is protected by applicable United States and international intellectual property laws and treaties.
Subject to legal liability, a User may not reproduce, copy, distribute, sell, rent, sub-license, store, or in any other manner re-use Content from Our Mobile Application or Our Site unless given express written permission to do so by Us.
You may:
Access, view, and use our Mobile Application and Our Site in a mobile phone or web browser (including any web browsing capability built into other types of software or applications);
Download Our Mobile Application or Site (or any part of it) for caching;
Print [one copy of any] page(s) from Our Mobile Application or Site;
Download extracts from pages on Our Mobile Application or Site; and
Save pages from Our Mobile Application or Site for later and/or offline viewing;
Our status as the owner and author of the Content on Our Mobile Application and Site (or that of the identified licensor, as appropriate) must always be acknowledged;
You may not re-use any Content printed, saved, or downloaded from Our Mobile Application or Site for commercial purposes without first obtaining a license from Us (or Our licensor, as appropriate) to do so. This does not prohibit the normal access, viewing, and use of Our Mobile Application or Our Site whether by business users or consumers.
User Content:
User Content on Our Mobile Application or Site includes (but is not necessarily limited to) title, name, surname, business name, business description, URL, postal address, telephone number, email address, and photos.
An Account is required if you wish to submit User Content. You agree that you will be solely responsible for your User Content. Specifically, you agree, represent, and warrant that you have the right to submit the User Content and that all such User Content will not be of an offensive, derogatory, or pornography nature.
Viruses, Malware, and Security:
Our status as the owner and author of the Content on Our Mobile Application and Site (or that of the identified licensor, as appropriate) must always be acknowledged;
We exercise all reasonable skill and care to ensure that Our Application and Site are secure and free from viruses and other malware.

We hereby exclude any, and all liability arising out of any actions (including, but not limited to those set out above) that We may take in response to breaches of these Terms of Use. Changes to these Terms of Use:
We may alter these Terms of Use at any time. If we do so, details of the changes will be highlighted at the top of this page. Any such changes will become binding on you upon your first use of Our Mobile Application or Site after the changes have been implemented. You are therefore advised to check this page from time to time.
